Homeowner Privacy Policy and Collection Notice

1. Read This First

We are not a solar installer. Solar Prospect is a referral service. We ask you a few questions about your home and electricity bill, and if you qualify, we pass your details to one or more solar installation businesses so they can contact you with a quote.

When you submit our form, you are asking to be contacted. You are giving your express consent for us and for the solar installer(s) we refer you to, to call, text and email you — including on a number listed on the Do Not Call Register.

You can change your mind at any time. See section 10.

This Policy is our collection notice under Australian Privacy Principle 5. Please read it before submitting your details.


2. Who We Are

GTSH Digital, a sole trader business trading as Solar Prospect, ABN 34 394 498 506.

We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles, the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).

We do not rely on the small business exemption in the Privacy Act. Because we disclose personal information to third parties for a benefit, we are an APP entity under section 6D(4)(c) and comply with the APPs in full.


3. What We Collect

When you complete a form on one of our websites or advertisements, we collect:

Your name

Your email address

Your phone number

Your residential address or postcode

Whether you own the property

Your approximate monthly electricity bill

Roof details — orientation, condition, shading, and where offered, a photo or satellite image you provide

Any financing indication you choose to give (see section 7)

Best time to be contacted

We also collect automatically:

IP address, browser and device type, operating system

The page and advertisement you came from, and advertising click identifiers (for example Meta fbclid, Google gclid, TikTok ttclid)

A timestamped record of your consent — the date, time, IP address, page URL and the exact consent wording you agreed to

We do not collect sensitive information as defined in section 6 of the Privacy Act, including health, racial or ethnic origin, political, religious or sexual orientation information. Please do not provide it.


4. Why We Collect It

If you do not provide the information above, we cannot check whether you qualify or refer you to an installer.


5. Who We Give Your Information To

5.1 Solar installation businesses

This is the main purpose of our service. We supply your enquiry to solar installation businesses operating in your area.

Depending on the campaign you responded to, your enquiry will be supplied as:

An exclusive referral — sent to one solar installer only, or

A shared referral — sent to more than one solar installer, so you can compare quotes. Where a form is a shared referral, we tell you the maximum number of installers on the form itself before you submit.

Once your details are supplied to an installer, that business handles your information under its own privacy policy and is independently responsible for complying with the Privacy Act, the Spam Act and the Do Not Call Register Act. We require every installer we work with to agree in writing not to on-sell or re-supply your details to anyone else.

We will tell you which installer or installers received your enquiry if you ask. Email [email protected].

5.2 Others

Service providers — hosting, CRM, email and SMS delivery, call tracking and telephony, analytics and advertising platforms

Professional advisers — lawyers and accountants, under confidentiality obligations

Law enforcement and regulators — where required or authorised by law, or to prevent a serious threat to life, health or safety

An acquirer — if the business is sold or restructured, subject to the acquirer being bound by this Policy

We do not sell, rent or supply your personal information to anyone for their own unrelated marketing purposes. The only third parties who receive your enquiry are solar installation businesses, for the purpose of quoting on solar for your home.


6. Your Consent to Be Contacted

By submitting your details you expressly consent to being contacted by GTSH Digital (trading as Solar Prospect) and by the solar installation business or businesses we refer you to, by:

Telephone, including where your number is listed on the Do Not Call Register

SMS

Email

Consent is not a condition of purchasing any goods or services. You are under no obligation to buy anything.

Telemarketing calls will only be made within the hours permitted by the Telecommunications (Do Not Call Register) (Telemarketing and Research Calls) Industry Standard 2017:

Monday to Friday: 9am to 8pm

Saturday: 9am to 5pm

No calls on Sundays or national public holidays

Times are local to you.

We do not use automated dialling with pre-recorded voice messages.


7. Financing and Credit — Important

We do not perform credit checks. We do not access credit reporting bodies. We do not obtain, hold, use or supply credit reports, credit scores, credit eligibility information or credit reporting information as defined in Part IIIA of the Privacy Act.

If a form asks about financing, your answer is entirely self-reported and optional. It is an indication of your own view of your circumstances, nothing more. It is not a credit assessment and no credit assessment is performed by us.

If you later apply for finance, that is a separate process conducted by the installer or their finance provider, under their own terms and privacy policy, with your separate consent.


8. Cookies, Advertising and Overseas Disclosure

We use cookies, pixels and tags from Meta (Facebook and Instagram), Google, TikTok and LinkedIn to deliver and measure our advertising. These record which ads you saw and whether you submitted a form.

You can control cookies through your browser settings and through the consent banner on our site. We honour Global Privacy Control and Do Not Track browser signals where technically supported.

Overseas disclosure (APP 8): your enquiry record is stored on servers in Australia. However, the advertising, analytics and communications platforms we use process data in the United States, and in other countries where those providers operate infrastructure, including Ireland and Singapore. Before disclosing personal information overseas we take reasonable steps to ensure the recipient does not breach the APPs, including through contractual data processing terms.

9. Security and Retention

We take reasonable steps to protect your information (APP 11), including encryption in transit and at rest, role-based access controls, multi-factor authentication on administrative systems, and contractual data protection terms with our providers.

When we no longer need your information we destroy or de-identify it.


10. Opting Out and Withdrawing Consent

You can withdraw consent at any time, at no cost.

Email marketing: click the unsubscribe link in any message

We will action your request within 5 business days and add you to a permanent suppression list.

Note: withdrawing consent stops us contacting you. If your details have already been supplied to a solar installer, you will need to opt out with that installer directly. Email us and we will tell you who received your enquiry and their contact details.


11. Accessing and Correcting Your Information

You can ask us for a copy of the personal information we hold about you, and ask us to correct anything that is wrong, out of date or incomplete (APPs 12 and 13).

There is no fee to make a request. We may charge a reasonable cost-based fee for supplying a large volume of information, and we will tell you the amount before proceeding

If we refuse, we will give you written reasons and explain how to complain

You may also ask us to identify the source of your information and to stop using it for direct marketing (APP 7).


12. Anonymity

You may deal with us anonymously or under a pseudonym where it is lawful and practicable. However, we cannot refer you to a solar installer without your real contact details.


13. Data Breach Notification

We comply with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act. If we suspect an eligible data breach, we will assess it within 30 days. If we conclude there has been an eligible data breach likely to result in serious harm, we will notify the Office of the Australian Information Commissioner and every affected individual as soon as practicable.


14. Children

Our services are directed to homeowners aged 18 and over. We do not knowingly collect information from children. If we become aware that we have, we will delete it promptly.


15. Complaints

16. Changes to this Policy

We may update this Policy. The current version is always at www.solarprospect.com.au/homeowner-privacy and the effective date appears at the top.

Exclusive campaigns

Appendix B — Consent Record to Capture

Log all of the following against every submission and retain for 5 years:

Supply this record to installers on request. It is the evidence that protects both parties if ACMA or the OAIC asks.


Appendix C — Email and SMS Requirements

Every commercial message you or your installers send must:

Identify the sender — business name and ABN, plus contact details valid for at least 30 days after sending

Contain a functional unsubscribe — must work for at least 30 days after the message is sent

Honour opt-outs within 5 business days — at no cost to the recipient

These are Spam Act 2003 requirements. Penalties apply per message, not per campaign.
